The Public Trustee acts as a watchdog to protect the interests of road traffic accident victims who have suffered personal injuries under the Motor Vehicles (Third-Party Risks & Compensation) Act (Cap. 189). He examines the adequacy of out-of-court settlements of compensation, ensures that all solicitor's fees and disbursements are reasonable and distributes the compensation monies to the persons entitled. After agreement on the Party and Party Costs with the Defendant(s)/ Insurer(s), solicitors acting for the injured must submit their proposal for their Solicitor and Client Costs in Lieu of Taxation to the Public Trustee for approval. The Public Trustee will approve or alternatively make his recommendations on the solicitors’ proposal for their Solicitor and Client costs and return it to the solicitors. Submission of Approval of Solicitor and Client Costs is one of the eServices under IPTO's Public Trustee eServices.

Depending on your role appointed, you will be able to Create New Case, Edit, Delete or View pending submissions. You will only be able to submit a case if you have been given the role of a submitter by your Organisation Account Administrator.
 
 
  b.
To create new case for Solicitor & Client Costs, please provide the Public Trustee's File Reference No. and click on icon as shown:

This page will display all the pending submissions that belong to your organisation. For each pending case submission, key information like File Reference No., Accident Victim Name, Solicitor File No., Last Updated By and Last Updated Date/ Time will be displayed. Each pending case will be retained in the system for ONLY 7 calendar days.
 
 
  d.
Click on Edit to modify details previously entered in pending submissions.
 
 
e.
Click on Delete to delete a pending submission. You will be prompted to confirm the deletion. Click on [Ok] to delete the Case or [Cancel] to cancel the action.

 2. Settlement Sum/ Proposal on Solicitor & Client Costs
 
  a.
The Public Trustee File Reference No., Name of Victim and Solicitor File Reference No. will be auto-displayed based on previously submitted case of Motor Accident Compensation Settlement.
 
 
  b.
The Total General Damages amount, Total Special Damages amount and Interests Claimed amount will also be auto-displayed.
 
 
  c.
The Public Trustee's fees will be determined based on the general damages amount. The fees charged will be S$300.00 if the general damages exceeds S$5000.00 but does not exceed S$10000.00, and S$500.00 for those exceeding S$10000.00.
 
 
 
   
 
 
 
 3. Public Trustee's Recommendations
 
  a.
The system will auto-approve the Solicitor and Client Costs if the proposed Solicitor & Client Costs is less than or equal to 15% of the Party and Party Costs, and the proposed Solicitor & Client Disbursements is less than or equal to the Party and Party Disbursements.
 
 
  b.
If either the proposed Solicitor & Client Costs or Disbursements or both do not meet the requirement set out in the above paragraph, the system will display the Public Trustee's recommended Solicitor & Client Costs or Disbursements or both.
 
 
  c.
If you agree to the recommendation by the Public Trustee, the system will proceed to the Transaction Summary Page. Otherwise, you will be brought to the appropriate Counter Proposal Page for you to indicate your counter proposal.

This page is displayed to you when both the proposed Solicitor & Client Costs and Disbursements are not approved by the Public Trustee.
 
 
  b.
You must state your reason for proposing your Solicitor & Client Costs at more than 15% above Party and Party Costs.
 
 
  c.
You must state your reasons for proposing your Solicitor & Client Disbursements of each item which contribute to your proposed Disbursements being more than Party and Party Disbursements.
 
 
  d.
After stating your reasons, you may then proceed to the Transaction Summary Page by clicking on the [Next] button.

  - "Solicitor & Client Costs is mutually agreed at S$XXX and disbursement at S$YYY."
